Terms and Conditions

INTRODUCTION

As part of the Texas Lung Cancer Conference, on April 10-12, 2025, in Austin, TX, IDEOlogy Health, LLC (“IDEOlogy”) is sponsoring the Texas Lung Cancer Conference Scientific Poster Competition (“Competition”). Your submission for consideration in this Competition assumes unconditional agreement and acceptance of all terms and conditions herein, including Submitter Responsibilities, below.

COMPETITION RULES

The Competition is open to all medical residents, oncology fellows, and junior faculty (within two years of initial appointment) legally residing in the United States (“Submitter”). Only one poster may be submitted by any eligible Submitter, although a Submitter may be a named author on other submitted Work. “Work” refers to the poster and all materials and related information in a submission for the Competition or otherwise provided by you to IDEOlogy.

All Work must be submitted to TexasLung@ideologyhealth.com and received by IDEOlogy by Friday, November 29, 2024. No late submissions will be accepted. All Work must comply with Abstract Submission Guidelines. IDEOlogy is not responsible for late, damaged, altered, or technical problems related to submissions, whether by electronic or physical submission, regardless of the reason.

All submissions will be judged on scientific merit, in accordance with the Abstract Submission Guidelines. The winner(s), amongst the eligible Submitters, will be selected by a panel of at least three experts in the relevant field, solely designated by IDEOlogy. Winners will be notified by email by Friday, December 13, 2024, and winners must accept prizes by Friday, December 20, 2024. Winners may be required to sign an affidavit confirming compliance with all the Competition rules, terms, and conditions.

SUBMITTER RESPONSIBILITIES

The Submitter affirms that: (1) Submitter has the authority to submit the Work for the Competition; (2) the submitted Work is the original creation of the Submitter, has not appeared in an identical form elsewhere and does not violate or infringe upon any copyright, trademark, confidentiality, privacy or other proprietary rights of any entity or person; and (3) the Submitter has secured any and all permissions and releases from any applicable third parties as required by law in the creation of the Work and royalty-free, irrevocable and perpetual license of said Work to IDEOlogy.

Submitter acknowledges and agrees that: (1) s/he has been approved by their employer, agency, or similar controlling entity to participate in the Competition; (2) the burden of determining the Submitter’s legal authority to use, display, submit and license rights of said Work and its components lies solely with the Submitter, who also bears the sole liability for any damages related to infringement upon the aforementioned rights of any other entity or person; and (3) no component of said Work is permitted to contain any language, imagery or themes that are offensive, objectionable, discriminatory or threatening against any persons, or illegal.

OWNERSHIP OF WORK

Submitter hereby agrees to license the Work to IDEOlogy for the full term of copyright and any extensions thereto on a nonexclusive, sublicensable, royalty-free, fully paid up, perpetual, irrevocable, worldwide basis. This license from Submitter to IDEOlogy shall include the right to: (i) publish, reproduce, distribute, publicly display and archive the Work in all forms, now known or later developed, and (ii) create adaptations or other derivative works based on the Work. Submitter affirms that he/she has the legal authority to grant these rights.

Submitter hereby agrees that the likeness, image/photograph, name and/or employment/institution of Submitter and other identifying information (including information Submitter provides to IDEOlogy or any other information about Submitter that is publicly available) may be used by IDEOlogy without compensation, unless prohibited by law, for purposes of this current and any future Competitions or similar Competitions, including, but not limited to, announcement of Competition participation and winners. Submitter waives any right to inspect or approve how IDEOlogy uses any submitted information or the Work.

PRIZES

Submitter acknowledges that participation in this Competition is voluntary and s/he will not receive compensation of any type associated with this submission or from any use of the Work by IDEOlogy.

Each Competition winner will receive complimentary registration for the Texas Lung Cancer Conference, up to two nights hotel stay, and up to $500 for economy/coach class airfare to the Texas Lung Cancer Conference. Prizes are non-transferrable, non-exchangeable, and no refunds or cash amounts will be provided for any unused portions of the prizes. Each winner will only receive one prize, regardless of whether such winner was named on multiple winning Works. Winners are responsible for all federal, state and local taxes, surcharges and fees applicable to the prizes. All prizes are at the sole discretion of IDEOlogy.

RIGHTS AND GOVERNING LAW

IDEOlogy retains the right to alter, effectively immediately, any component of this Competition at any time without prior notification, including, but not limited to, suspending and/or prematurely terminating this Competition prior to the close of the submission date. Should IDEOlogy decide to prematurely terminate this Competition, any materials physically delivered to IDEOlogy will be destroyed, any electronic submissions will be deleted, and all rights will revert back to the Submitter.

All Works associated with any Submitter suspected or known to be in violation of the legal conditions and guidelines set forth in this Competition will be disqualified at IDEOlogy’s sole determination without the obligation of prior notification or means to appeal. IDEOlogy retains the right to overrule or amend any decisions by judges, without prior notification.

IDEOlogy makes no representation or warranty, express or implied, regarding the Competition. All Competition’s legal conditions and guidelines are governed in all respects by the laws of the state of Texas, without application of any of its principles of conflicts of law. The federal and state courts in Travis County, Texas are the exclusive forum/venue to bring any claim and resolve any dispute that arises out of or relates in any way whatsoever to these terms or Submitter’s participation in the Competition generally.

These terms are the only agreement concerning their subject matter and supersede any related prior agreements, whether written or spoken (other than prior signed written agreements administered by IDEOlogy). Whenever the words “include,” “includes,” or “including” are used in these terms, they are deemed to be followed by the phrase “but not limited to.”

RELEASE OF LIABILITY AND INDEMNITY

Submitter agrees to release and forever discharge IDEOlogy, and its affiliates, agents, consultants, any other companies associated with the Competition, and each of their respective officers, directors, employees, shareholders, representatives, and agents (collectively, the “Released Party”) from and against any and all claims or causes of action, including libel, defamation, invasion of privacy, right of publicity, copyright infringement, or violation of any other right that Submitter may now or in the future hold arising out of out of participation in the Competition or receipt or use of the prize (including any travel or activity related thereto), or any of the rights granted to IDEOlogy hereunder.

Submitter agrees to defend, indemnify, and hold harmless each Released Party against every loss, damage, liability, claim (including from third parties), action, judgement, settlement, interest, fine, and other cost or expense, including attorneys’ fees, that arise out of or relate in any way whatsoever to the Conference or Competition, including if partially or entirely caused (or alleged to be caused) by a Released Party’s negligence or other fault (excluding only their gross negligence).
